What is the difference between the principles 'the asl is ibaha' and the 'asl is waqoof'?

The Asl al-Ibaha principle states that all actions are permissible in Islam unless there is a clear Qur'anic or Hadith prohibition on it.

  • Quranic verse: "He has only forbidden to you dead animals, blood, the flesh of swine, and that which has been dedicated to other than Allah. But whoever is forced [by necessity], neither desiring [it] nor transgressing [its limit], there is no sin upon him. Indeed, Allah is Forgiving and Merciful." (Qur'an 2:173)

  • Hadith: "The things that Allah has permitted are numerous, and the things that Allah has prohibited are few." (Sahih al-Bukhari, Muslim)

The Asl al-Waqoof principle states that all actions are frozen or suspended in Islam unless there is a clear Qur'anic ayat or Hadith for it.

  • Quranic verse: "And do not approach unlawful sexual intercourse. Indeed, it is ever an immorality and is evil as a way." (Qur'an 17:32)

  • Hadith: "Every act of disobedience is a sin, and every sin is in the Fire" (Sahih al-Bukhari, Muslim)

In summary, the Asl al-Ibaha and Asl al-Waqoof are principles that determine how the Islamic laws should be understood.
